Words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

• Application means the software program provided by the Company downloaded by You on any electronic device, named GFood.
• Application Store refers to the digital distribution service operated by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) through which the Application has been downloaded.
• Affiliate means any entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for directors or management authority.
• Country refers to: Uttar Pradesh, India.
• Company (referred to as “the Company”, “We”, “Us”, or “Our”) refers to Gfood Delivery Private Limited, 323 Infront of CMO Residence, Tata Motors, Bijli Khera, Banda, Uttar Pradesh – 210001.
• Device means any device that can access the Service such as a computer, mobile phone, or tablet.
• Service refers to the Application.
• Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• Third-party Social Media Service means any content, services, or data provided by a third party that may be displayed, included, or made available by the Service.
• You means the individual or entity accessing or using the Service.

Acknowledgment

These Terms govern the use of this Service and form a binding agreement between You and the Company. Your use of the Service indicates your acceptance of and compliance with these Terms.

By accessing or using the Service, You agree to be bound by these Terms and Conditions. If You disagree with any part, You may not access the Service.

You must be at least 18 years old to use this Service.

Your use of the Service is also subject to Our Privacy Policy.

Termination

Limitation of Liability

To the maximum extent permitted by law, the Company and its suppliers’ total liability shall not exceed the amount You paid through the Service or USD $100 if no purchase was made.

We are not liable for indirect, incidental, or consequential damages (including loss of profits, data, or privacy) arising from or related to the use of the Service, even if advised of the possibility of such damages.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE” without warranty of any kind. The Company disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

Some jurisdictions do not allow certain exclusions, so the above limitations may not apply to You.

Governing Law

These Terms are governed by the laws of India, specifically within the jurisdiction of Uttar Pradesh, excluding conflicts of law rules.

Disputes Resolution

In case of any dispute, You agree to first attempt to resolve it informally by contacting Us at admin@gfood.in.

Severability and Waiver

If any provision is held invalid or unenforceable, the remaining provisions will remain effective. Failure to enforce any right does not constitute a waiver of future rights.

Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated at least 30 days prior to taking effect. Continued use of the Service means You accept the revised Terms.
